Internet Privacy in Chile

Chile's internet regulatory environment is defined by two parallel frameworks. The 2010 net neutrality law (Ley 20.453) prohibits ISPs from blocking, throttling, or discriminating against internet traffic based on content or application, one of the earliest such protections in the world. It restricts what providers may do with your traffic, though it is a competition and access rule rather than a privacy rule, and it does not by itself limit lawful data requests. Obligations touching connection data do exist. Article 222 of the Code of Criminal Procedure governs judicially authorised interception, and it also requires telecommunications companies to keep an updated register of the IP address ranges assigned to their subscribers for at least one year, an obligation added by Law 20.526 of 2011. Law 21.459 of 2022, which brought Chile in line with the Budapest Convention, went further and added Article 218 bis: the Public Prosecutor can require any service provider to preserve data it already holds, for 90 days and up to 180, while a judicial order for release is sought. Both routes run through the courts. Chile's data protection framework has been significantly updated. Ley 19.628 (1999) has been replaced by Ley 21.719, published on 13 December 2024 and in force since 1 December 2026. The new law introduces GDPR-style rights: purpose limitation, data subject access and deletion rights, breach notification within 72 hours, and a supervisory authority, the Agencia de Protección de Datos Personales, with power to investigate and fine. Penalties reach 20,000 UTM for the most serious violations, rising to 4 percent of annual revenue for repeat offences by large companies. Smaller firms receive written warnings instead of fines during the first year. Ley 21.719 applies to any organization processing personal data of Chilean residents, including organizations based outside Chile.
